Booking Terms and Conditions

Reservation
To confirm a booking please complete and sign the Booking/Reservation Form. On the Booking Form you have been asked to acknowledge the Booking Terms & Cancellation Fee Policy as follows. We require a 20% deposit of the full booking amount, paid by cheque or direct debit into our bank account as supplied. This deposit is non refundable. The balance is due in 60 days prior to departure. Bookings are valid for 7 days without deposit, where after the dates will be released for other customers. All prices quoted are in Australian dollar and all passengers are required to complete the Booking Form and acknowledge the Booking Terms and Conditions together with a 20% deposit.

We recommend that you book and plan you flights/hotel to Broome or Derby at the time of making your reservation with us.

Cancellation Policy
Notification of a cancellation must be received in writing.  In the event of a cancellation 30 days prior to departure no refund is given.  In the event of a cancellation 60 days within departure, the booking is forfeited and no fees will be refunded. The deposit paid is non-refundable. Any loss in fees or deposit paid can be claimed from you travel insurance policy under the terms of the policy.

Accommodation Policy
Prices are based on twin share occupancy per room. Sole occupancy will be charged at the normal rate plus a single supplement. If deciding and willing to share the accommodation, the single supplement can be waived.

Medical and Travel Insurance
We, Kimberley Sunset Cruises Pty Ltd, accepts no responsibility for the actions of any conditions that results in the purchaser not meeting a deadline or a booking condition. We recommend very strongly that all passengers arrange suitable comprehensive travel insurance, cancellation insurance and medical insurance at time of booking. We are traveling in very isolated areas and in any circumstance, which may occur, that will force you to cancel or leave an expedition whilst in progress, this will act as a protection. Advice Kimberley Sunset Cruises of any medical conditions or dietary requirements at booking or if a condition is diagnose after making a booking. Any accidents and or personal ailments which could occur during the expedition should be reported to the caption immediately. Emergency evacuation could be arranged at the customer's own expense.

Responsibility & Health Issues
Passengers should fully admit, be aware and understand that:
1) That they accept the risk of suffering from seasickness; 2) Smoking is not permitted inside the vessel only outside in nominated areas; 3) That sufficient travel insurance and medical cover has been taken out before departure and that any charges incurred by passengers for medical or travel reasons shall be the sole responsibility of the passenger; 4) That passenger is in good health and fit to undertake the cruise and activities; 5) That the passenger agrees to indemnity Kimberley Sunset Cruises from and against all claims, charges, fines, penalties and costs arising as a result of any claim made against the carries in this respect.

Liability
It is the passenger's sole responsibility for damages or loss of personal property or any illness, death or injury that may take place. As we provide a adventurous trip, there might me dangers and discomforts involved, and we will take the best possible care to avoid unnecessary risks, we do point out that all passengers should be prepared to take the risks involved with a trip of this nature.

Equipment & Gear onboard
We do supply fishing gear onboard, but feel welcome to bring your own with.

Baggage
Kimberley Sunset Cruises accepts no responsibility for baggage, jewellery, money, documents and any other valuables that the passenger keep on their person, in their cabin or in their luggage. We do not accept responsibility for any loss, delay or damage to a passenger's baggage or personal effects. All baggage will remain in control of the passage and should be kept in passenger's allocated cabin.

Changes, cancellations or delays of a Cruise
In the case of operational reasons, weather conditions or delays in excess of 24hours, we may refund part of the fare paid on a pro rata basis minus any unforeseen costs. Kimberley Sunset Cruises PTY LTD reserves the right to disqualify any participant at any time during the cruise if he or she feels the participant is physically incapable and/or if a participant will jeopardize either the individual involved, or the group.  Kimberley Sunset Cruises PTY LTD reserves the right to cancel an itinerary before departure for any reason whatsoever which may make the trip inadvisable.

Kimberley Sunset Cruises PTY LTD is not responsible for any expenses incurred by cruising participants in preparing for this trip including airline tickets, transport and transfer arrangements.

Information is valid until April 2009.

Whilst all prices are correct at the time of release, Kimberley Sunset Cruises PTY LTD, reserves the right to alter charter dates and prices may be subject to change.
